Default Beware selling Braniff/associated models on Ebay

Apparently Braniff and other associated trademarks are now owned by a patent troll who is getting listings for models removed from Ebay as "counterfeit items" because of licensing.

I just had a listing for an Aeroclassics Panagra DC-6 removed. (side note - anybody interested in a Panagra DC-6? )

It seems a strange business strategy to alienate the very audience who might be interested in anything Braniff-related...

I sent an email arguing that it was counterproductive to target individuals selling on Ebay, and requesting them to reinstate my listing, and was advised that as long as I relist the model as "Used" or "New Old Stock" (I have not seen NOS as an option on Ebay, but whatever...) that it will not trigger the listing removal. We shall see...

They also mentioned that they were bringing more models to market:

Had the problem selling the Corgi Sea King LAPD a few years back. had it pulled 3x times due to infringement.
Ended up not mentioning LAPD in the advert.
So the only realistic way is to not use the word Braniff in the listing. I don't think the pictures will matter.

I would think any Braniff would be identified by buyers from the pictures.
or even use associated terms Jelly Bean or Calder.

The issue is for searching.
If a potential buyer searches 'braniff 747 1/400' it will no longer appear in that search and the buyer will assume no one has the model listed. A buyer won't look for a specific model by searching '1/400 747 or 1/400' as this will take for ages to go through the search results.

The issue is for searching.
If a potential buyer searches 'braniff 747 1/400' it will no longer appear in that search and the buyer will assume no one has the model listed. A buyer won't look for a specific model by searching '1/400 747 or 1/400' as this will take for ages to go through the search results.
Every detail but Braniff will help, Registration, mfg, etc. if there’s a way to put tags in an ebay listing maybe try to mention Braniff there?

Well according to their reply, having the name in the description will not be a problem, you just need to list the item as "Used." I have to rebuild my listing for the Panagra DC-6 tonight since I can't access the original one anymore after it was removed, but I'll report back if that is successful or not. I don't want to get another "counterfeit strike" from Ebay though.

I would expect most experienced buyers looking for this type of thing will use various search terms, aside to Braniff, to find what they are looking for.

Try BNF Int'l or BI Int'l.

In any case, trolls like these don't last long because it is very hard to enforce trademark of something which is in the public domain. Considering how many "Braniffs" there were between bankruptcies, I seriously doubt that the early Braniff, such as el Dorado schemes can be enforced.

So many leaches and bottomfeeders in our hobby!! So sad!!

You guys aren't reading what I wrote. You can list as Braniff, you just have to list it as Used, not New.

I have the Panagra listing back up, as well as a Braniff 727, and so far no issues with the listings since they are now listed as Used.
