Angry Beware!

BOIENG 777-346ER is the ID to watch out!!!!!!!!

A thread came out already about this guy, but the thread came in late for me.

Last Dec 2007, I bought I think 9 planes from this guy. Paid via Paypal & following day, he sent me a private email saying that due to an urgent business trip, he won't be able to mail my planes until Jan 13, 2007. I waited.

While waiting, I saw a thread about this guy & turned out that he is had issues with other collectors. The day when that thread showed up, he sent me an email (Jan 10, 2008) saying that he is back & that my planes are on its way. I somewhat stayed neutral with my comments on the forum because, I was giving him the benefit of the doubt. I even asked him to publicly declare that he has shipped out the planes...but he never replied on the posting I made.

On the day when I paid my papal dues to him, following day, I ordered some items from HKG & 2 weeks after, items came safe & sound.

The day when he said that he is back & that for me to just wait since it is the busy season, I again ordered another item from another HKG seller & 1 1/2 after, the items came in good package.

I emailed this guy asking the whereabouts of my planes & he said, just wait. 1 week passed I asked him again & said that it is Chinese New Year, let the holidays pass as it is a busy time of the year.

I have him an ultimatum saying that if my planes won't come in, I will initiate a dispute case with Paypal against him.

He said to just wait & that Paypal can not do anything about it.

Still no plains, I inititiated the dispute case with paypal but with disappointment, paypal can not purse the case anymore & I also received an email from this guy saying that "there is nothing he can do, but offered to check with post office".

It's now going to be a month that I have paid for those planes, not even a box or a notice did I recieve from him about the planes.

BEWARE OF THIS SELLER. BOIENG 777-346ER. He goes by the name of Charles Ryan...although not sure if this is his real name.

He is probably reading this now. To you Ryan, I hope you get rich with the money I paid for nothing & that if you have a family, I hope that your kids & wife or even yourself will find the best food with the money I paid in your paypal account & that one day, you still have some money left to buy medicine for any sickness or ailments that you may have in the future.

Geez - thats a rough deal.
I'm sorry to hear what you've been through.
I've lost a few things in the mail over the years - I could not attain whether it was the post or the seller but this sounds sus.....
Why could'nt paypal do anything ?

Could these have actually been lost in the post? Ask Mr. Ryan to provide proof of posting with a date posted and a tracking number. If this was a failing of the postal system and he was a decent trader he would make a claim against the post office and give you at least a partial refund. Here in UK, parcels are automatically insured for up to £30 ($60) providing you keep your receipt of posting and can prove the value of the item posted.

yeah i think Adrian is right...!! you can ask him for some proof of dispatch which he can email you or something... atleast it wud prove whether he shipped your planes or not..!!

The PayPal response is a puzzle to me. I think there is a 60 day window in which to report a dispute. If the seller cannot produce a tacking number to prove that the shipment was made the money paid will be returned to the buyer.

I have just now confirmed it. The time limit is 60 days. Unless you purchased the models prior to December 12 then you still have time to file a dispute with PayPal. I would do it now.

Hey Baxter.

I'm sorry to hear what had happened. Let's all help each other to sort the things out.

I know Ryan, and he has never let me down, I have purchased alot of models from him. He's a good seller. He had been busy due to the Chinese new year.

Now don't get me wrong, I'm neutral on this case.

I will forward this thread to Charles Ryan.

I apologize for my bad remarks.

My Dad usually say that "you see what man's soul is made of from the words that come out of his mouth". 100% I agree with my Dad on this.

You can disprove my Dad's thesis if you will indeed refund me with the money.

Your planes? For sure, I will definitely send thme back as I don't think I want this as part of my collection especially now that there is a bad omen in it.

When can I expect the refund?

Folks, just trying to be fair here & at the same time, I didn't mean to stir up this unruly discussion about language & stirring up nationality issues.

But in fairness with Charles, & thank him for that, he did refund my $. However, I lost a 3rd of the money I paid him due to currency fluctations, plus Paypal charges, I just don't know how will this loss be recouped by Charles?....

But then again, I still don't tolerate abrupt burst of emotion to justify foul language. We are human beings here & fellow collectors who deserve at least the respect & courtesy of being human & civilized to say the least.

For Charles, for sure, when the planes come in, I will definitely send them back to you...PM me to confirm your address as PAYPAL has said that your address is not verified....as an update, since writing of this post, I have not received your planes.

I'm with Peewee here, I don't understand why paypal refused your request to open a claim. They usually side with the buyer right away and they would have at least put a temporary hold on the payment. I don't understand a few things, you were the buyer, what paypal charges did you incur? The Canadian dollar is at par with the American dollar now for a few months, how did you lose a third of your money?

Believe me, I'm not the language police! I just find it interesting that none of the moderators stepped in with a warning, since this is just the kind of thing they want to clamp down on. And yeah, I agree, it's offensive to be labelled as obnoxious just because you might belong to a certain nation, religion, race, etc. I see everyone for the individual they are...an American can be a jerk, but so can a Chinese, Brit, French, whatever. Oh, you know what, you are right ELY707. This guy still owes me...he paid me in Singapore $ & no wonder I am short. I went into my paypal accnt & saw that the currency used was singapore.

So, I guess for Charles Ryan...you still owe me, & you know how much more you have to put in my accnt.

I will check with PayPal on this.

Simply make a paypal request for non received item or call your credit card company to cancel the payment.

Exactly. If the shipper cannot produce proof of shipment paypay will refund. The process is simple. This also works for sellers too, referring to Ebay. I have had to process non paying bidders via the Ebay format. I normally will give them 30 days to pay but by then I figure they will not so I process it for a refund of my fees.

I was warned not to wait too long though. I read somewhere that buyers waited too long to open up a claim only to get a responce that it's too late for it. So no refunds.
My question is : How long must the buyer wait til he can set up /request to open a claim ? (Without passing the deadline date where it's too late.)

Did you read my post above? If you did then ignore that if you are referring to PayPal and not Ebay. Here is PayPal's limit.

Most disputes are the result of simple misunderstandings. It’s best to initiate communication with the seller as soon as you recognize a potential problem.

"You can open a dispute in the Resolution Center within 45 calendar days of payment. By opening a dispute, you are able to communicate directly with your seller to work out a problem transaction.

If you and your seller are unable to agree on a solution, you must escalate the dispute to a PayPal claim within 20 calendar days of the date the dispute was opened. By escalating to a claim, you would be asking PayPal to review the case and decide the outcome."

That means that if you opened the dispute on the 45th day then you have another 20 days in which to escalate to a claim for a total of 65 days maximum. If you opened the on the 10th day you would then have 20 more days from that date to escalate to a claim. One almost needs to be both a lawyer and a mathematician to accomplish this, it would seem.

Here is what Ebay says:

"To report a problem with an item that was not received or significantly not as described, go to eBay’s dispute console. The problem needs to be reported between 10 and 60 days after the purchase date.

When you report an item, you indicate whether you haven’t received the item or whether you have received it, but it was significantly different from the item description.

Report a problem with an item.

View your open disputes in the dispute console overview

Note: Your eligibility for reimbursement through our buyer protection programs is determined by the payment method that you’ve used and the eBay country site where you have purchased the item.

If you’ve paid with PayPal, you are fully covered by PayPal Buyer Protection and will be redirected to the PayPal Web site to report your problem.

You can only report a problem on the specific eBay country site where you’ve purchased the item.

If you bought the item as a guest, you will need to register to open a dispute."
