That may be the manufacturers official line, but here in UK and I would guess also The European Union, its the retailer who sold you the product and in law its the retailer who is responsible for his sales contract with you, and, therefore its the retailer who is responsible for supplying "goods that are of merchantable quality".
Adhering strictly to the letter of the law the retailer (in the UK) is responsible for repairing or exchanging the goods.
Don't know about U.S.law though.
