Recently in one of the Philadelphia newspapers was a story about a local model company who was challenging those intel. property lawsuits when it came to military aircraft. What makes his argument different is that the military planes are developed with taxpayer-funded research, etc...I don't know if it will hold water but I'm pulling for the little guy.
